Collaborative Law In Solving Business Disputes in Family Cases


Collaborative is a relatively new approach to legally solving disputes in both family law as well as commercial law. In collaborative law, the aim is to narrow down the problem and the root cause of the dispute and work towards settling it instead of going to the court. The parties involved hire their own separate attorneys, one neutral family professional (mental health professional) and one neutral financial professional, and move towards resolving the matter and coming to a mutual compromise.



Why collaborative law?

Collaborative law is being increasingly used in the resolution of business disputes. One of the major advantages in using collaborative law lies in the fact that as compared to traditional litigation, these cases are not brought into court. In addition, collaborative is far less expensive than traditional litigation. There is the added advantage of privacy and of course the promise of mutual agreement and settlement. Another advantage is that often, unlike cases that are brought before the court, disputes that are solved using collaborative law reach an agreement much faster than cases that are argued by means of traditional litigation.


Attorneys need to be well aware of the intricacies of the collaborative law process and the ethics of certain cases when they are settling disputes. One partner owning a business, or an interest in a business is often a common high conflict dispute. With an agreed upon neutral financial professional, the parties save both money and time when determining a fair value for the business, and how that business factors into the dissolution of marriage process. This can also give some stability and ease to the other business partners if the divorcing partner resolves his or her divorce in quick and efficient manner.
